JUDGE RULES LAUREL VALLEY SUIT CAN GO TO TRIAL
Trial begns Monday in Greensburg

7/30/2010

Westmoreland County Judge Gary Caruso yesterday denied preliminary objections to a lawsuit that seeks to stop the closing of Laurel Valley High School, setting the stage for a Monday start to the non-jury trial.

The school district’s attorneys had asked that the suit be dismissed, but Caruso said that decision must be made at trial. The plaintiffs, a citizens group called Save Our Rams Education (SORE) filed the suit, arguing that the April 19th vote to close Laurel Valley was arbitrary and capricious. Their attorney, Joel Sansone, told the judge he will introduce evidence next week proving that some school board members and administrators stand to gain financially from the closing because they hold gas and mineral rights on the school’s property.

The group also claims the district failed to properly consider the dangers of traveling Route 711 to send Laurel Valley students to Ligonier. Earlier this week, the district released the morning bus schedule for Laurel Valley secondary students, revealing that some will be on the bus for over an hour even in optimal conditions.

Anticipating large crowds of citizens, Caruso has moved the trial from his courtroom to a larger courtroom at the Westmoreland County Courthouse in Greensburg.
