A preliminary hearing has been scheduled for next week in the case of a Blairsville man who is accused of criminal homicide in the death of his 20-month-old stepson. 


The hearing for Juan Campbell is scheduled for next Tuesday.  District Attorney Patrick Dougherty formally filed the criminal homicide charges against Campbell on Monday.  Police say the child’s mother was in the hospital after giving birth to another child and Campbell was watching 20-month-old Malachi Patterson, along with two 6-year-olds.  He put Malachi in his bed with one of the other children and police say, that at some point, he fell out of bed and hit his head. 


The child was whimpering so police say Campbell placed his hand over his mouth until he stopped breathing.  The child was taken to Indiana Regional Medical Center and then to Conemaugh Memorial Medical Center before being transferred to Children’s Hospital, where he died over the weekend.  Dougherty says he plans to seek a conviction on first degree murder but has declined to comment on whether he will seek the death penalty.
