Indiana County District Attorney Pat Dougherty is detailing the circumstances leading up to the death a 22-month-old boy last month in Burrell Township.  Dougherty says that at the time of Malachi Patterson’s death, allegedly at the hands of his step-father Juan Campbell, county child welfare workers were looking into how he suffered a broken leg while he was being cared for by Campbell. 


Police say Patterson was injured falling off a bed and Campbell placed his hand over the boy’s mouth to quiet his crying, stopping the child’s breathing and killing him.  He’s facing charges of criminal homicide, aggravated assault, recklessly endangering another person and endangering the welfare of a child.  Dougherty says that at the time of Patterson’s death, he was in a cast up to his mid-chest, covering his left leg and half of his right leg. 


Donna Morgan of the state Welfare Department says the family was under investigation at the time but declined to share further details.  At the time of his death, Malachi Patterson’s mother was in the hospital after giving birth to another child.  Dougherty says he still hasn’t decided whether to pursue the death penalty.  He is awaiting the return of final autopsy results.  Campbell will not be in court until a scheduled preliminary hearing on July 30th in front of District Judge George Thachik.
