Significant updates are coming to Pennsylvania’s Minimum Wage Act, according to state officials.
PA Department of Labor & Industry Secretary Jennifer Berrier announced this morning that changes to regulations of the Minimum Wage Act will take effect today with the goal of protecting wages earned by thousands of workers across the commonwealth and to level the playing field for employers competing in a tight labor market.
Final-form regulations cover five primary areas for tipped workers: an update to the definition of “tipped employee”, information on a federal regulatory update governing employer tip credits so employers can take a tip credit under certain conditions, an update on tip pooling among employees, prohibiting employers deducting credit card and other non-cash payment processing fees from an employee’s tip, and requiring employers to clarify that automatic service charges are not gratuities for tipped employees.
The proposal was part of Governor Tom Wolf’s agenda for protecting broader workers.
