Indiana County President Judge Thomas Bianco has granted an unopposed prosecution motion to reschedule arguments on Kevin Foley’s petition for relief from his conviction in the murder of John Yelenic.
William Ross Stoycos of the State Attorney General’s Office filed the original motion to dismiss Foley’s petition last month after signaling his intent to do so in June. The 60-year-old Foley, a former state trooper, was found guilty in 2009 of the April 2006 stabbing death of Yelenic at Yelenic’s Blairsville home. Foley was living with Yelenic’s estranged wife at the time and the attack occurred as Yelenic was about to sign divorce papers.
Foley’s conviction was upheld by State Superior Court in 2012 and re-affirmed by the Supreme Court in 2017. He’s serving life in prison at SCI Mahanoy in Schuylkill County. His third petition for relief is now re-scheduled from August 19th to September 30th.
