Indiana County President Judge Thomas Bianco will hear augments this week on a motion by the prosecution to dismiss Kevin Foley’s petition for relief from his murder conviction. Foley was found guilty in 2009 of the stabbing death three years earlier of Blairsville dentist John Yelenic.
The now-60-year-old Foley is a former state trooper, whose conviction was already upheld by the State Superior Court in 2012 and by the Supreme Court in 2017. He’s serving life in prison at SCI Mahanoy in Schuylkill County and will be returned to Indiana County to appear in court this Thursday.
