Indiana County President Judge Thomas Bianco last week granted an unopposed motion for a ten-day extension of time for the prosecution to file for dismissal of Kevin Foley’s successive petitions for relief from his murder conviction. Attorney William Ross Stoycos of the state attorney general’s office filed the motion. Bianco had previously scheduled arguments on the petition for August 19th.
Foley, a former state trooper, is seeking to reverse his first degree murder conviction in the 2006 death of Blairsville dentist John Yelenic. He was found guilty by an Indiana County Court jury in 2009 and is incarcerated at SCI Mahanoy in Schuylkill County, serving a life sentence without the chance of parole.
